What are the eligibility requirements for Partner Visa subclass 309 and 100?

 

The eligibility criterion for visa subclass 309 are as follows:

Sponsor requirements

Subclass 309 visa applicants must have a sponsor when they lodge their application and when they are on a 309 visa. The eligible sponsor is usually their partner. The Department of Home Affairs must approve the sponsorship.

Age requirements

The legal age to marry under Australian law is 18; therefore, married applicants should be 18 years or older at the time of visa application. Moreover, the applicants in de facto relationships should also be 18 years or older when they apply.

Meet relationship requirements

The subclass 309 visa applicant must be the spouse/ de facto partner of a permanent resident of Australia, Australian citizen or eligible New Zealand citizen. This condition applies when they make an application and when their application is decided upon. 

Health requirements

The applicant and any family member who applies, along with the applicant, must meet the health requirements. The Department of Home Affairs might also ask other family members who have not applied for the visa to meet the health requirements.

Two years must have passed since the applicant made an application for the combined visa subclass 309 and visa 100 Australia for them to be eligible to be assessed for the permanent visa. You might be granted a permanent visa in less than two years if you were in a long-term relationship or your sponsor held a certain visa before you applied. 

Continue to meet relationship requirements

The applicant must continue to be the spouse/ de facto partner of the same person who sponsored their temporary Partner 309 visa. The applicant must:

  • Be married or be in a de facto relationship.
  • Live together or don't live permanently separately, and apart.
  • Have a genuine and continuing relationship.
  • Be mutually committed to a shared life.

Under certain conditions, the applicant might still be eligible for a permanent visa 100 Australia if their relationship breaks down or their partner dies before they are granted a permanent visa.
