A person holding an Employer Nomination Scheme 186 Visa Australia can sponsor eligible family members to come to Australia. They can also enrol in Australia's public health care scheme. The applicant can apply for Australian citizenship in case they are eligible.

What are the different streams of 186 Visa (Employer Nominated Scheme)?

Transition Stream

You must have been working full-time for at least 3 years with your employer on your subclass 457 or subclass 482 visa. Unless you held (or had applied for) a subclass 457 visa on 18 April 2017, then you only need to have been working for your employer for at least 2 years.

Direct Entry Stream

For applicants who have at least 3 years of relevant work experience.

If you were temporarily stood down, had to take unpaid leave or had your hours reduced due to COVID-19, this time can still be counted towards the time worked for your employer.

Agreement Stream

For applicants who are nominated by an employer under a labour agreement.

What are the eligibility requirements for Employee Nomination Scheme 186 Visa?

 

Eligible occupation

The occupation you intend to work in must be listed on the relevant list of eligible skilled occupations. 

Licensing, registration or membership

The applicant should be a member of a professional body, licensed, or registered if it is mandatory in the state or territory the ENS 186 visa applicant intends to work.

Relevant work experience

Most ENS 186 visa applicants need at least three years of relevant experience in their occupation if applying for a Direct Entry stream. In case the person is applying under the Labour Agreement stream or Temporary Residence Transition stream, then the employer must have sponsored the ENS 186 visa applicant to work full-time on subclass 482 or 457 visa for a minimum of three of the four years before nominating them for the subclass ENS 186 visa. 

Nomination requirements

The ENS 186 visa- Direct Entry stream applicant must be nominated by an Australian employer with an active and lawful business. The person must apply for the Direct Entry stream visa within six months of approval of their nomination. However, if the person is applying under the Labour Agreement stream, then the Australian employer must also be a party to a labour agreement. If the applicant is applying for the 186 visa Australia- Temporary Residence Transition stream, then their employer must have sponsored the applicant to work full-time on subclass 482 or 457 visa for a minimum of three of the four years before nominating the applicant for the subclass 186 visa Australia. 

Age requirement

The visa applicant must be under 45 years of age when they apply for the 186 visa Australia. In the case of the Labour Agreement stream, they must be under 45 years of age when applying unless the labour agreement provides otherwise.

Health requirements

The applicant and any family member who applies, along with the applicant, must meet the health requirements. The Department of Home Affairs might also ask other family members who have not applied for the ENS 186 visa to meet the health requirements.

Skill Assessment

The ENS 186 visa applicants need to undertake a skills assessment to prove they have the skills required to work in the nominated position.

English requirement

The ENS 186 visa applicant must have competent English to be eligible for this visa.

Character requirement

The applicant and any family member applying for the ENS 186 visa, along with the applicant, must meet the character requirements. The Department of Home Affairs might also ask other family members who have not applied for a 186 visa Australia to meet the character requirements.

If the applicant or any of their family members owe the Australian government any money, they must have paid it back or should have a formal arrangement to pay it back.

Previous visa cancellations and refusals

The applicant must not have had a visa cancelled before, or a previous application refused.

Other Conditions

If the applicant is applying under the Labour Agreement stream and is in Australia, then they must hold a substantive 457 or TSS visa issued under a labour agreement. If the person applies under the Temporary Residence Transition stream, then they must currently become the primary visa holder of either:

  1. A subclass 482 visa granted for an occupation listed on the Medium to Long-term Strategic Skills list.
  2. A subclass 457 visa not granted under the Labour Agreement stream.
  3. A Bridging visa A, B, or C.
