Parents of Australian citizens or permanent residents can apply to migrate to Australia. You must be an Australian permanent resident and have lived in Australia for at least two years , in order to be an eligible sponsor. Your parents must also meet ‘Balance of Family Test’ in order to qualify for parent visa. 

Your parents can apply for permanent or temporary parent visa sub classes.

Who is eligible?

You may apply for a parent visa if your child is:

  • an Australian citizen or
  • an Australian permanent resident or
  • an eligible New Zealand citizen

You must also:

  • meet the balance of family test requirement i.e. 50% or more of your children live in Australia or 50% or more of your children live permanently in Australia than in any other country.
  • provide an assurance of support which is a legal document confirming that you receive financial support in certain circumstances so you do not have to rely on social security payments. In most cases this document will be provided by your child who is sponsoring you.

Business Innovation & Investment (Provisional) Visa

subclass 188

This is a temporary visa that allows you to own and manage a business in Australia, conduct business and investment activity in Australia or undertake an entrepreneurial activity in Australia.

There are a number of streams for Business Innovation & Investment (Provisional) Visa Subclass 188:

Business Innovation Stream

This stream is for people with business skills. It lets you operate a new or existing business in Australia.

Business Innovation Extension Stream

This stream is for holders of Business Innovation & Investment (Provisional) Visa in the Business Innovation Stream and allows to extend their stay in Australia for 2 more years

Investor Stream

This stream requires you to invest AUD 1.5 million in an Australian State or Territory and maintain business or investment activity in Australia.

Significant Investor Stream

This stream required you to invest AUD 5 million in Australian investments that meet certain requirements and maintain investment activity in Australia.

Significant Investor Extension Stream

This stream is for holders of Business Innovation & Investment (Provisional) Visa in the Significant Investor Stream and allows to extend their stay in Australia for 4 more years

Premium Investor Stream

This stream is for people who are nominated by Austrade and requires you to invest at least AUD 15 million in Australian investments and/or philanthropic contributions.

Entrepreneur Stream

This stream requires you to carry out entrepreneurial activities in Australia.

Eligibility

Nomination

You must be nominated by an Australian State or Territory Government agency or Austrade. The nomination must not be withdrawn after the application is submitted.

All States and Territory governments have their own criteria for nominations.

Invitation

You must be invited to apply for this visa.

You will need to submit an expression of interest (EOI) to the Department of Home Affairs to inform that you wish to apply.

Australian Values Statement

You and any family members aged 18 years or over, who apply for this visa must:

English Language Requirement

You and any family members aged 18 years or over, who apply for this visa must have at least functional English.

If not, then you will be asked to pay the 2nd instalment of Visa application charge.

Health Requirement

You and any family members who apply for this visa with you must meet Australia’s health requirement. The Department of Home Affairs might also ask that other non-migrating family members meet the requirement.

Character Requirement

You and any family members who apply for this visa with you must meet Australia’s character requirement. The Department of Home Affairs might also ask that other non-migrating family members meet the requirement.

No debt to Australian Government

If you or any family member owe any money to Australian Government, it must have been paid back or have an approved arrangement in place to pay it back.

Previous Visa Cancellations & Refusals

You might not be eligible for this visa if you have had  a visa cancelled or refused while you were in Australia.

Unacceptable Activities

You and your partner must not have had any history of involvement in business or investment activities that are not generally acceptable in Australia.

Business Ownership

You must have had an ownership in 1 or 2 businesses in 2 out of 4 fiscal years immediately before you receive an invitation to apply. The businesses must have at least AUD 500,000 turnover in each of those 2 years.

You also must own at least:

  • 51% of business when turnover is less than AUD 400,000/ year; or
  • 30% of business when turnover is more than AUD 400,000/year; or
  • 10% of business when it is operated by a public listed company

For professional, technical or trade services, you must have spent less than half your time providing those services rather than general management of the business.

Points Test

You must score at least 65 points on the points test.

Assets

Business Career

You must have had a successful business career and a genuine intention to continuously own and manage a business in Australia.

Age Requirement

You must be less than 55 years of age at the time of invitation to apply for this visa.

If you are older, a State or Territory might invite you to apply if your business will be of exceptional economic benefit.

Previous Visa Held

You must already hold a Business Innovation and Investment (Provisional) visa (subclass 188) in Business Innovation stream and have held it for at least 3 years.

You must also not have held more than one of these visas.

Demonstrate Residency Need

You must be able to demonstrate the requirement for your substantial presence in Australia to operate your business and manage day to day operations.

Maintained Ownership

Your main business must have been operating in Australia for at least 2 years immediately before applying for this extension and continue to have ownership interest in that business.

Maintained Commitment

You must have maintained your commitment to stay directly involved in the general management and decision making of the business.

Assets

At the time of invitation, you, your partner or you and your partner must have combined total net business and personal assets of at least AUD 2.25 million. 

These assets must have been lawfully acquired and be available to transfer to Australia within 2 years of visa being granted.

Business Career

You must have had directly managed one of the following for 1 out of 5 fiscal years immediately before your receive an invitation to apply:

  • a qualifying business in which you, your partner or you and your partner combined had at least 10% ownership; or
  • an eligible investment of at least AUD 1.5 million owned by you, your partner or you and your partner combined.

Invest AUD 1.5 million

You must make a designated investment of at least AUD 1.5 million in the State or Territory in which the nominating State or Territory government agency is located.

You must hold the designated investment for 4 years from the date investment certificate is issued.

Business Experience

You must:

  • have at least 3 years’ experience managing one or more qualifying business or eligible investments
  • have a successful record of qualifying business or eligible investment activity
  • have demonstrated a high level of management skill

Intend to Live in Nominated State/ Territory

You must have a genuine intention to live for at least 2 years in the State or Territory in which you have made the investment application.

Age Requirement

You must be less than 55 years of age at the time of invitation to apply for this visa.

If you are older, a State or Territory might invite you to apply if your business will be of exceptional economic benefit.

Points Test

Invest AUD 5 million

You must make a complying significant investment of at least AUD 5 million and have a genuine intention to hold that investment for 4 years. 

The funds must be invested in the following proportions:

  • at least AUD 500,000 in venture capital and growth private equity funds, which invest in start-ups and small private companies
  • at least aUD 1.5 million in approved managed funds. The managed funds must invest in emerging companies listed on ASX
  • a balancing investment of AUD 3 million in managed funds

Direct investment in residential real estate is prohibited and indirect investment in residential real estate by managed funds is strictly limited.

These investment also must not be used as security or collateral for a loan.

You must already hold a Business Innovation and Investment (Provisional) visa (subclass 188) in Significant Investor stream.

You must also not have held more than one Business Innovation and Investment (Provisional) visa (subclass 188) Significant Investor Extension stream visa.

Continue Holding Investment

You must continue to hold your complying significant investment.

Assets

At the time of invitation, you, your partner or you and your partner must have combined total net business and personal assets of at least AUD 15 million. 

These assets must have been lawfully acquired, unencumbered and be available to make the complying premium investment in Australia.

Not bring action against Commonwealth

You must agree not to bring any action against the Commonwealth for any loss relating to your complying premium investment. This also applies to any family member aged 18 years or over who is also an applicant.

Invest AUD 15 million

You must make a complying premium investment of at least AUD 15 million in any of the following:

  • ASX listed assets
  • Australian government or semi-government bonds or notes
  • corporate bonds or notes issued by an Australian exchange listed entity, investment grade rated Australian corporate bonds or notes
  • Australian proprietary limited companies that operate qualifying businesses
  • real property in Australia, excluding residential property
  • deferred annuities issued by Australian registered life companies
  • State or Territory government approved philanthropic contribution

Direct investment in residential real estate is prohibited and indirect investment in residential real estate by managed funds is strictly limited.

These investment also must not be used as security or collateral for a loan.

Complying Entrepreneur Activity

You must either be undertaking or proposing to undertake a complying entrepreneur activity in Australia. You must have a genuine intention to continue this activity in Australia.

A complying entrepreneur activity must relate to an innovative idea that will lead to:

  • the commercialisation of a product or service in Australia; or
  • the development of an enterprise or business in Australia

This activity must not relate to:

  • residential real estate
  • labour hire
  • purchase of an existing enterprise or franchise in Australia.

Approved Entity Funding

You must have one or more legally enforceable agreements to receive funding with a total of at least AUD 200,000. The funding must be from one of the following entities:

  • Commonwealth Government agency
  • State or Territory government agency
  • Publicly funded research or innovation organisation
  • Higher education provider
  • Investor registered as an Australian Venture Capital Limited Partnership or Early Stage Venture Capital Limited Partnership

At least 10% of the funding must be payable to the entrepreneurial entity within 12 months of the activity starting in Australia. This entity can be an individual, a company or partnership.

Additionally, you must have held at least 30% interest in this activity.

All of the funding must be unencumbered and lawfully acquired.

Age Requirement

You must be less than 55 years of age at the time of invitation to apply for this visa.

If you are older, a State or Territory might invite you to apply if your business will be of exceptional economic benefit.

Investor Stream

This stream is people who have held Business Innovation & Investment (Provisional) Visa (subclass 188) in the Investor Stream.

Significant Investor Stream

This stream is for people who have held Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream or the Significant Investor Extension stream.

Premium Investor Stream

This stream is people who have held Business Innovation & Investment (Provisional) Visa (subclass 188) in the Premium Investor Stream for 12 months.

Entrepreneur Stream

This stream is for people who have held Business Innovation and Investment (Provisional) visa (subclass 188) in the Entrepreneur stream for 4 years.

Residence Requirement

  • Business Innovation and Investment (Provisional) visa in Business Innovation Stream
  • Special Category Visa (subclass 444)
  • Business Innovation and Investment (Provisional) visa in Business Innovation Extension Stream
  • in certain cases, a subclass 457 visa

Minimum Turnover

You must have had an annual turnover of at least AUD 300,000 in the 12 months immediately before you apply from your main business or businesses.

Assets

For the 12 months immediately before you apply, you or your partner or you and your partner combined must show at least 2 of the following:

    • Net assets of AUD 200,000 in your main business
    • Net personal and business assets of AUD 600,000 in Australia
    • Equivalent of at least 2 full-time eligible employees in your main business

Employees

Your employees must work in your main business and:

  • be Australian Citizen, Australian Permanent Residents or eligible New Zealand passport holders

Own and Manage a Business

2 years immediately before you apply, you must have had:

  • and continue to have an ownership interest in up to 2 main businesses in Australia
  • a direct and continuous management role
  • submitted BAS to ATO
  • an ABN for each of your businesses

For the same period, you must own at least:

  • 51% of total business value with a turnover of less than AUD 400,000/ year
  • 30% of total business value with a turnover of more than AUD 400,000/ year
  • 10% of the total business value that is operated by a public listed company

Business Acquisition

If you bought your main business from a person who applied for or held:

  • a Business Innovation and Investment (Permanent) Visa; or
  • a Permanent Business Skills Visa ( subclasses 890, 891, 892 or 893)

At thew time of acquisition you must be able to demonstrate that you and that other person co-owned the business for at least 1 year before you apply

Residence Requirement

You must have been in Australia for at least 2 years in the 4 years immediately before you apply.

Hold Designated Investment

You must have held your designated investment for at least 4 years if the provisional visa was granted for an application made on or after 1 July 2015.

For applications made prior to this date, you must have held your designated investment for at least 3 years and 11 months.

Residence Requirement

You or your partner must have spent a minimum time in Australia calculated as below:

Either you have been in Australia for no. of days equivalent to:

  • 40 x no. of complete years in the period in which you held a subclass 188 visa in the Significant Investor stream and
  • 40 x no. of years in the period in which you held a subclass 188 visa in the Significant Investor Extension stream

Or your partner has been in Australia for no. of days equivalent to:

  • 180 x no. of complete years in the period in which you held a subclass 188 visa in the Significant Investor stream and
  • 180 x no. of years in the period in which you held a subclass 188 visa in the Significant Investor Extension stream

This time spent in Australia does not have to be continuous.

Hold Complying Investment

You must have held your complying investment or complying significant investment for the whole period during which you held your subclass 188 visa. You must also inform the Department of any times you transferred funds from one investment to another.

If any part of your investment is or was a direct investment in an Australian proprietary company, then:

  • if the period of the direct investment was less than 2 years, the company must have been a qualifying business for the whole period, or
  •  if the period of the direct investment was 2 years or more, the company was a ‘qualifying  business’ for at least 2 years, or
  •  if the company has been unable to operate as a ‘qualifying business’, you must have made a genuine attempt to operate the business as a ‘qualifying business ’.

Hold Complying Investment

You must have held your complying investment or complying significant investment for the whole period during which you held your subclass 188 visa. You must also inform the Department of any times you transferred funds from one investment to another.

If any part of your investment is or was a direct investment in an Australian proprietary company, then:

  • if the period of the direct investment was less than 2 years, the company must have been a qualifying business for the whole period, or
  •  if the period of the direct investment was 2 years or more, the company was a ‘qualifying  business’ for at least 2 years, or
  •  if the company has been unable to operate as a ‘qualifying business’, you must have made a genuine attempt to operate the business as a ‘qualifying business ’.

Visa

Visa cost starts from AUD 6,415. You can include family members in this visa application, but an additional charge applies for each of the members included in the application.

The payment for this visa is required in 2 installments.

First installment is required at the time of the application. the 2nd installment is required when the Department of Home Affairs asks.

Application

you must be in Australia to apply for this visa. you must still be in Australia when the decision is made on your application.

any family members who are included in this visa application also must be in Australia when applying for this visa.

Processing

The Department of Home Affairs does not provide any specific time period within which visa applications will be processed under this category. However, on average, applications for this visa can take anywhere from 10-16 years.

The reason for this extended time frame is due to this category being subject to capping and queueing under the Migration program planning levels.

For 2019-20, the cap for this visa category has been set at 7,371 places. Note: These places are allocated to the entire Visa Category and not just this subclass.

Business Owner

subclass 890

This is a temporary visa that allows parents to live in Australia if their child is an Australian citizen, Australian permanent resident or an eligible New Zealand citizen. However application charge for this visa is significantly higher than other parent visas.

This visa  allows applicant to live in Australia for up to 2 years. By choosing the Subclass 173 option first and then applying for the Subclass 143 Visa option later, you could spread the costs of the Contributory Parent Visa over those two years.

Eligibility

Sponsor

you must be sponsored by an eligible sponsor. Usually an eligible child is the sponsor. In case where the child is under 18, you can be sponsored by an eligible relative or community organization.

The Department of Home Affairs must approve the sponsorship.

Balance of Family test

you must meet the balance of family test, which is:

Business Talent (Permanent) Visa

This is a permanent visa that allows parents to live in Australia if their child is an Australian citizen, Australian permanent resident or an eligible New Zealand citizen. However application charge for this visa is significantly higher than other parent visas.

It is important to note that the temporary subclass 173 visa is not a prerequisite for the permanent subclass 143 visa.

Eligibility

Sponsor

you must be sponsored by an eligible sponsor. Usually an eligible child is the sponsor. In case where the child is under 18, you can be sponsored by an eligible relative or community organization.

The Department of Home Affairs must approve the sponsorship.

Health requirement

you and any family members who apply for this visa with you must meet Australia’s health requirement. The Department of Home Affairs might also ask that other non-migrating family members meet the requirement.

Balance of Family test

you must meet the balance of family test, which is:

Investor Visa

subclass 891

This is a temporary visa that allows the older/aged parents to live in Australia for up to two years. This visa cannot be extended or renewed

If the parents want to stay in Australia permanently, they can apply for the permanent Contributory Aged Parent 864 visa after the temporary 884 visa is expired.
