To be eligible for a Partner Visa you must be married to, or in a de facto (common law) relationship, with an Australian citizen or permanent resident. Interdependent, or same sex partners are also eligible. Your partner must sponsor you for a period of 2 years. After this, if the relationship is still genuine and continuing, you may be eligible for permanent residence.

subclass 309

This is a temporary visa that allows the partner or spouse of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia.

You can stay until the decision is made on the permanent visa application.

Both the temporary visa and permanent visa (subclass 100) are applied at the same time.

Eligibility

Sponsor

you must be sponsored by an eligible sponsor. 

The Department of Home Affairs must approve the sponsorship.

Health requirement

you and any family members who apply for this visa with you must meet Australia’s health requirement. The Department of Home Affairs might also ask that other non-migrating family members meet the requirement.

Relationship

you must be the spouse or de facto partner of an Australian citizen, permanent resident or an eligible New Zealand citizen.

the de facto relationship must have existed at least 12 months prior to visa application.

Character requirement

you and any family members who apply for this visa with you must meet Australia’s character requirement. The Department of Home Affairs might also ask that other non-migrating family members meet the requirement.

Age

you must be 18 years or older to apply for this visa

Previous Visa Cancellations & Refusals

you might not be eligible for this visa if you have had  a visa cancelled or refused while you were in Australia.

Visa

Visa cost starts from AUD 7,715. this is the combined visa fee for both the temporary and permanent visa.

You can include family members in this visa application, but an additional charge applies for each of the members included in the application.

Application

you must be outside Australia when you apply for this visa and at the time of the decision.

any family members who are included in this visa application also must be outside Australia when applying for this visa.

Processing

The Department of Home Affairs provides below time frames as a guide:

  • 75% of applications in 15 months
  • 90% of applications in 20 months

Partner (Migrant) Visa

subclass 100

This is a permanent visa that allows the partner or spouse of an Australian citizen, permanent resident or eligible New Zealand citizen to live permanently in Australia.

Both the temporary visa and permanent visa (subclass 100) are applied at the same time.

Eligibility

Existing Visa

you must either hold:

  • a Partner (Provisional) visa subclass 309 or
  • a Dependent Child Visa subclass 445

Usually, you will have to wait for at least 2 years since you applied for the Provisional and Permanent visa.

Continued Relationship

you must continue to be the spouse or de facto partner of the same person who sponsored you for the Provisional visa.

you must also be living together and not separately on a permanent basis.

Visa

visa cost is combined and is paid at the time of Provisional visa application.

Application

visa is applied at the same time as the Partner (Provisional) Visa subclass 309

Processing

The Department of Home Affairs provides below time frames as a guide:

  • 75% of applications in 14 months
  • 90% of applications in 21 months

This visa category is subject to capping and queueing under the Migration program planning levels.

For 2019-20, the cap for this visa category has been set at 39,799 places. Note: These places are allocated to the entire Visa Category and not just this subclass.

Partner (temporary) Visa

subclass 820

This is a temporary visa that allows the partner or spouse of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia.

You can stay until the decision is made on the permanent visa application.

Both the temporary visa and permanent visa (subclass 801) are applied at the same time.

Partner (Permanent) Visa

subclass 801

This is a permanent visa that allows the partner or spouse of an Australian citizen, permanent resident or eligible New Zealand citizen to live permanently in Australia.

Both the temporary visa and permanent visa (subclass 801) are applied at the same time.

Eligibility

Existing Visa

you must either hold:

  • a Partner (Temporary) visa subclass 820 or
  • a Dependent Child Visa subclass 445

Prospective Marriage Visa

subclass 300

This is a temporary visa that allows you to come to Australia to marry your prospective spouse and then apply for the Partner Visa.

You can stay up to 9 months 

Eligibility

Sponsor

you must be sponsored by your prospective spouse. 

The Department of Home Affairs must approve the sponsorship.

Health requirement

you and any family members who apply for this visa with you must meet Australia’s health requirement. The Department of Home Affairs might also ask that other non-migrating family members meet the requirement.

If you marry your prospective spouse and apply for the Partner Visa before your Prospective Marriage visa expires, then you pay less fee towards Partner visa application.
